Terms of Use
This English version is a courtesy translation provided for convenience. The legally binding version is the German version; this site is operated from Germany and German law applies.
Important Notice & Terms Supplement for Non-German Users (English)
The full supplement for non-German users (publisher status, FTC disclosure, AS-IS disclaimer, U.S. state privacy notice, DMCA-style takedown) is maintained once in the Legal Notices and applies equally to these Terms.
1. Scope; no contractual relationship
These terms govern the use of the NadirAlpha website and its content. Use is free of charge. Accessing the website or using its content does not create any contract, in particular no information, advisory or other obligation, between you and the operator. If you use the website, we ask you to observe the terms below.
2. No investment advice
All content is neutral financial information, no investment advice, no investment recommendation, no investment research within the meaning of MiFID II. No price targets, ratings or buy/sell recommendations are issued. Factual comparisons of company guidance with reported actuals are purely arithmetic and contain no judgment, no price target and no recommendation regarding any financial instrument. The operator is not a supervised securities or financial services firm. The linked original documents of the issuers always prevail. You make investment decisions solely at your own responsibility.
3. Information quality, timeliness and availability
The content of this website is not exhaustive and constitutes a summary of the topics covered. We make all reasonable efforts to ensure the accuracy and completeness of the data but, to the extent permitted by law, accept no responsibility for it. You should monitor changes to the content yourself. We do not guarantee any minimum availability of the website, although we strive for uninterrupted operation. We may change or supplement the website and its content at any time and undertake no obligation to keep the content continuously updated; changes to these terms are made exclusively in accordance with Section 13.
4. Copyright, database right and license
Unless indicated otherwise, all rights (including copyright, trademark and other proprietary rights) in this website and its content belong to us or our licensors. The entirety of the reports is a database within the meaning of Sections 87a et seq. UrhG (German Copyright Act, sui generis database right); NadirAlpha is its maker. The extraction or re-utilization of substantial parts of the database, once or repeatedly and systematically, is prohibited. Your use of the website transfers no rights whatsoever in the website or the content to you; we merely grant you a simple, revocable license to access the website and view the content within the scope of these terms.
5. No commercial use, no redistribution
This website is intended for your personal, non-commercial use. You may not modify, copy, distribute, transmit, publicly display, reproduce, publish, license, commercially exploit, create derivative works from, transfer or sell content, including for the purpose of generating advertising revenue or reach on your own offerings. Passing content on to third parties for reuse or retransmission requires our prior written consent. Setting hyperlinks to our pages is unaffected by this and is expressly permitted and welcome.
6. Automated extraction (scraping), text and data mining
The automated reading, copying or mirroring of content, including in part and irrespective of the means used; is prohibited without prior written consent. Setting hyperlinks to our pages is unaffected by this and is expressly permitted and welcome. Crawling by search engines for the purpose of indexing remains permitted. At the same time, we expressly reserve the use of the content for text and data mining (§ 44b(3) UrhG, German Copyright Act); this reservation of use is also declared in machine-readable form.
7. Data sources
The reports are based on public original filings of the companies covered (in particular SEC EDGAR, EDINET, investor relations publications). These sources are third-party content; neither we nor the respective source operators warrant their accuracy or completeness, and the mention of a company does not constitute an endorsement or recommendation. Quotations from filings are identified as such and linked.
8. Linked sites
Links to third-party websites are provided for convenience. We do not adopt their content as our own, have no influence over it and accept no responsibility for it; links may become outdated without us maintaining them.
9. Advertising and affiliate links
Content marked "Anzeige" (Ad) is advertising. Ads and affiliate links (including broker offers) are visually separated from editorial content, are served title-neutrally and do not refer to any specific financial instrument presented in the respective report. Affiliate commissions have no influence on the content, selection, ordering or updating of the reports.
10. Own precautions and IT security
You are responsible for taking your own precautions against malware. We are not liable for impairments of, or damage to, your systems arising in connection with the use of this website or linked websites, unless we are guilty of intent or gross negligence.
11. Restriction of access
We reserve the right to restrict, suspend or terminate access to the website or individual content at any time without notice; in particular in the event of violations of these terms (such as Sections 5 and 6).
12. Warranty and liability
Use of this website is free of charge. The reports are produced with AI assistance from original filings (transparency pursuant to Art. 50 EU AI Act) and validated automatically; no warranty is given for accuracy, completeness or timeliness.
We are liable without limitation for intent and gross negligence as well as for damage resulting from injury to life, body or health. In the event of a slightly negligent breach of a material obligation (an obligation whose fulfilment makes proper use possible in the first place and on whose observance you may regularly rely), liability is limited to the foreseeable damage typical for this kind of use. Otherwise, liability for slight negligence is excluded; this applies in particular to indirect damage, lost profits and consequential damage as well as to the unavailability of the website. Liability under the German Product Liability Act (Produkthaftungsgesetz) and under any guarantee given remains unaffected.
13. Changes
We may amend these terms with effect for the future; the version published on this page at the relevant time applies.
14. Governing law and jurisdiction
The law of the Federal Republic of Germany applies. To the extent legally permissible, the place of jurisdiction is the operator's seat; mandatory consumer-protection venues remain unaffected.
In addition, the Legal Notices apply (financial information warning, AI production, risk notices).
